The Pros and Cons of Chapter 13 Bankruptcy

Honest Legal Advice About Chapter 13 Bankruptcy Petitions

One of our guiding philosophies at the Leawood, Kansas, law firm of The Mathews Group, LC, is that we are a small firm that treats our clients with the same respect that the biggest client receives at a larger law firm. What's more, we pride ourselves on offering a unique model for providing legal services.

We take very seriously our job to give our clients legal counsel — and that means doing much more than a 15-minute interview followed by a whiz-bang bankruptcy filing where the client never knows what's happening or where he or she is in the bankruptcy process.

Instead, we treat bankruptcy filings as part of our larger asset protection practice. We listen to clients who come to our office for help with burdensome debt, and we give honest and practical advice about the best options for solving their current financial and legal woes.

If we can resolve your financial troubles without a bankruptcy petition, we will tell you so. And if we do decide that bankruptcy is your best option, you will work directly with an experienced lawyer every step of the way.

The Basics of Chapter 13 Bankruptcy Filings

Chapter 13 bankruptcy is a form of bankruptcy available to individuals and families who do not qualify for Chapter 7 bankruptcy. Sometimes known as "debt reorganization bankruptcy," Chapter 13 bankruptcy works best for people who have steady income and can therefore pay off their high credit card debts or back payments on their mortgage. Due to unexpected financial troubles, however, they may need extra time to get current on their debts.

With Chapter 13 bankruptcy, the debtor reports all debts and all income and assets to the court, along with a proposed repayment plan that fits the individual's income and ability to pay. The bankruptcy court examines the proposed repayment plan, reviews any objections from creditors, and then approves or modifies the repayment plan.

One of the many advantages of a Chapter 13 bankruptcy plan is that the debtor makes one monthly payment directly to the court, which distributes the payment among creditors according to the repayment plan. Once you file Chapter 13 bankruptcy, you no longer face harassing phone calls from creditors, and you are able to make one monthly payment to cover your debts.

One of the other major advantages of Chapter 13 bankruptcy is that it is a powerful defense against a foreclosure option. Filing Chapter 13 bankruptcy almost always allows you to keep your house.
